The Lessor shall rent the equipment listed in the invoice to the Lessee whom must adhere to the terms and conditions mentioned below:

PAYMENT TERMS:

The rental fee is based on a rate mentioned in the invoice per day, plus any additional fees incurred. Additional charges shall be added in the event the equipment is damaged or missing any parts. All charges shall commence from the Effective Date of this invoice. Lessee shall pay to the Lessor an additional lease charge per day for each day the equipment has not been returned, in addition to the daily rental fee.

SECURITY DEPOSIT

In addition to the rental fee, the Lessee shall pay a security deposit of INR 5000 prior to receiving the device and at the time of delivery of the device. This deposit shall be returned to the Lessee upon return of the device, subject to the option of the Lessor to apply it against any charges or damages incurred.

The rental amount paid is NON-REFUNDABLE only the security deposit is REFUNDABLE.

DAMAGES

All devices sent to you have been checked to be in a working condition prior to dispatch. Upon receipt of the device, you must ensure that the same is playable. Any anomaly, if found, must be reported to us by email. Failure to check and/or report the same will be constituted as your having received a playable disc.

Upon receipt of the device, we will verify for the device. In the event of damage, we will email you and intimate you about the same. The determination of "damage" will be at the sole discretion of the lessor. Accordingly, we will charge you MRP of the device. All such damage charges will be chargeable against your refundable security deposit and if the same is insufficient, the lessee shall pay the same to the lessor.

ALTERATIONS

Lessee shall make no alterations to the device without prior written consent of the Lessor. All alterations shall be property of the Lessor and subject to the term within. Lessor shall have the right to inspect the equipment during Lessee’s normal business hours upon request.

INDEMNITY

Lessee agrees to indemnify and hold Lessor harmless from any loss, liability, demand, claim or legal proceedings brought or threatened, including expenses suffered or incurred arising out of Lessee use of the device, the functionality of the device, or any violation of this Agreement.

LEASE TERM

Lease term is the term agreed in the invoice. At the end of the Lease term, the Lessee shall be obligated to return the equipment to the Lessor.

LOCATION

The device shall be located at the address mentioned in the invoice, and shall not be removed from that location without the Lessor’s prior written consent.

OPTION TO RENEW

If the Lessee is not in default upon the expiration of this lease, the Lessee shall the option to renew this Lease for a similar term on such terms as the Parties agree upon.
